The evidence problem

COMAH regulation 15 requires the on-site emergency plan to be tested at least every three years, and the Competent Authority expects the test to exercise the people who would run the response, not only the procedures. An inspection will ask which incident controllers have exercised their role, when, and what was found.

A full-scale test means stopping or slowing production, pulling shift teams together and bringing in the emergency services. Most sites manage one such test per plan cycle, which leaves most incident controllers with no personal record of having exercised the plan.

Findings from a test have to be recorded and acted on. If the record is a slide deck and a sign-in sheet, the inspector's next question is what each controller actually did.
